Standard Terms & Conditions of Service
Visa Voyage provides a visa and passport acquisition service to
its customers.
1. Definitions
- “Relevant Authority” shall mean the Department of Home Affairs, an embassy or consulate of a foreign country or any other authority or agent to which application may be made. “Travel document” shall mean any passport, visa or document issued by a relevant authority.
2. Scope of Service
- A completed visa or passport application delivered to, or collected by Visa Voyage will, where possible be scanned for completeness by Visa Voyage staff before being submitted to the relevant authority for consideration. Failure to find errors or omissions on applications shall not be construed as a breach of service.
- Where necessary Visa Voyage will disburse on behalf of the Customer, the funds necessary to cover the costs of such submission to the relevant authority.
- These disbursements shall be paid to Visa Voyage by the Customer prior to submission to the relevant authority, whether the travel document has been issued or not. Failure to pay such disbursements within 7 days of such demand shall attract additional disbursement charges, which are set by Visa Voyage from time to time.
- Once the travel documents have been collected from the relevant authority, Visa Voyage will arrange the return the travel documents to the Customer. Visa Voyage has the right to hold such travel documents until such time that the Customer has settled its account to Visa Voyage satisfaction.
- Visa Voyage will provide to the Customer, information regarding costs, requirements and application forms relating to the acquisition of travel documents. This information will be provided to the best of Visa Voyage ability and knowledge at the time. Visa Voyage will not be responsible should the information provided be in any way inaccurate or outdated.
- Visa Voyage shall charge such service fees as it deems necessary or that have been agreed upon for its services and such fees are due and payable once Visa Voyage has received the application on behalf of the Customer.
3. Liability
- Visa Voyage liability to its Customers for any negligent or grossly negligent error or omission by a Visa Voyage staff member shall be limited to an amount of R5 000.00 for direct costs incurred by the Customer as a result of any one incident of such negligence. Consequential or indirect costs are specifically excluded.
- Where Visa Voyage fails, delays or is unable to carry out its obligations under this contract or any loss occurs due to strikes and / or lockouts (whether of Visa Voyage own employees or those of others and whether or not Visa Voyage could have avoided the same by acceding to the demands of the employees responsible for such action), acts of God, war, terrorism, criminal acts of third parties such as theft and arson, fire, flood, embargo, litigation, acts of government or any agency instrumentality or any political subdivision thereof or any other cause beyond the control Visa Voyage.
- Visa Voyage will not be liable for the negligent actions of third parties which result in Joss or damage to the Customer, in particular courier companies used in the process of obtaining travel documents.
4. Use of Website and Payment Gateway
- Customer privacy – Visa Voyage shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined Protection of Personal Information Act, No. 4 of 2013, which can be downloaded from http://www.justice.gov.za/legislation/acts/2013-004.pdf.
- Visa Voyage may, in its sole discretion, change the terms and conditions or any part thereof at any time without notice.
